- Introduction
1.1. These Terms and Conditions (“Terms”, “Agreement”) govern your use of our website (“website”) located at www.btcfitness.com.au and clients and consumers (“client”, “you”, “your”) of BTC Fitness (“we”, “us”, “our”) services and your participation in any/all fitness and training programs, group or individual exercise sessions and other physical fitness services (“service(s)”) provided by BTC Fitness.
1.2. By accessing or using our website and services, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you should not access the website or service.
1.3. These services and website are operated by:
BTC Fitness.
ABN 82 381 404 030 (BTC FITNESS).
BTC Fitness is fully insured for public liability and professional indemnity to a value of $20,000,000.
BTC Fitness is owned and operated by Charlotte Jane Walton who is a fully qualified personal trainer having gained the following qualifications via Tafe (Queensland):

All staff members of BTC Fitness work under Charlotte’s strict supervision.
All staff members at BTC Fitness hold a current, valid Blue Card for working with children and First Aid certification.
BTC Fitness may change these terms and conditions from time to time, so you should check these terms and conditions regularly. Continued usage of our products and services after a revision in these terms and conditions constitutes your acceptance of those revisions.
2. Services Provided
2.1. We offer fitness programs, online courses, and educational resources tailored for both adults and adolescents aged 13-17. These include (but are not limited to):
- Personal training sessions.
- Group fitness classes.
- Online fitness courses and digital resources.
2.2. ‘Teen Training’ services and other services aimed at adolescents aged 13-17 provided during school programs will align with the Education (General Provisions) Act 2006 (Qld) and adhere to school policies where applicable.
2.3. All in-person, adolescent training sessions are supervised by fully qualified professionals who hold current Blue Cards for working with children.
2.4. All participants wishing to take part in our Teen Training program or other adolescent based services must be aged 13-17 and have parental or guardian consent before accessing our services.
2.5. As a parent/guardian of an adolescent aged 13-17 wishing to use our services, you confirm that you are their parent or legal guardian and have the authority to consent on their behalf.
2.6. ‘Three Free Sessions’ trial. We sometimes offer new clients an introductory offer of three free sessions to try out our services. This offer may be withdrawn at any time at our discretion. After a client has completed their three free sessions, there is no obligation to continue with our services. All clients wishing to take advantage of our three free sessions offer are required to complete a medical pre-screening form and sign a document accepting our terms and conditions. This is to protect both ourselves and our clients. The medical pre-screening form is a legal requirement in Queensland.
3. Health and Safety
3.1. You, the client, acknowledge the risks and dangers associated with the strenuous exercise that forms part of the content and services we provide, which include, but are not limited to serious bodily injury, death or other damage or injury. You assume all such risks and responsibility for damages, liabilities, losses or expenses which you may incur as a result of your participation.
3.2. Parents/guardians acknowledge and accept that physical activity involves inherent risks. While we take every precaution to ensure safety, we cannot guarantee risk-free participation.
3.3. Each time you use our website or services; you must ensure you are in good physical condition and know of no medical or other reason why you should not exercise. If unsure, you should not use our services or website until you have sought appropriate medical guidance and been given clearance by a qualified medical practitioner.
3.4. You agree to give us all relevant personal health and fitness information both before and during the course of any exercise program or other activity, this includes full disclosure of any medical conditions, allergies or injuries both past and present. You also agree to complete our Pre-Exercise Health Screening Questionnaire upon our request.
In some cases, your qualified personal trainer may wish to discuss further your answers given on the health screening questionnaire for clarification.
In some cases, responses you give will require that you obtain medical guidance before exercising. You acknowledge that pre-exercise or other screening is no substitute for medical advice and does not guarantee against injury or death.
3.5. You affirm that all the information you give us will be true and accurate and not misleading in any way. We will not be held responsible for any consequences arising from our actions/inactions, guidance, instruction or advice given or taken by us based on incorrect information provided by you. You must not use our services or website if you are suffering from any illness, disease, injury or other condition that could be a risk to your health or safety or that of other members and staff. We may suspend or cancel your agreement with us if we have reason to suspect that you have not complied with this paragraph or these terms & conditions more generally.
3.6. BTC Fitness and its affiliates make no guarantee, warranty, representation or promise of any health outcomes associated with your use of the services or website, including but not limited to weight loss, weight gain or other changes in body composition or your health or wellbeing more generally.
3.7. In no event shall BTC Fitness, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from:
• Your access to or use of or inability to access or use our services.
• Any and all injuries sustained while participating in our sessions and classes or services.
• Any changes in body composition, real or imagined, positive or negative, that arise from participation in our services.
3.8. Our trainers are certified under Australian fitness industry standards and maintain qualifications in first aid and CPR.
4. Eligibility
4.1. For safety and security reasons all clients wishing to participate in one-to-one adult personal training sessions must be at least 18 years old.
4.2. All children and adolescents wishing to participate in our Teen Training (“Teen Training”) program and other programs and services aimed at adolescents, must be 13-17 years old.
4.3. All participants in any/all of our ‘in-person’ (group training classes, personal training sessions etc.) services must have completed a Pre-Exercise Health Screening Questionnaire to acceptable standards to safely participate. If further medical advice is required before participation, it is the client’s responsibility to receive this advice from an appropriately qualified medical practitioner and this advice must be relayed to BTC Fitness, in writing, digital or analogue, before exercise and/or training can commence.
4.4. We have the right to refuse to deal with clients, at any time, at our sole discretion, including the suspension or termination of your agreement with us, if we believe that you may or will bring our reputation, those individuals who represent us in the market place and our other users into disrepute or otherwise will interfere with other parties’ rights to have reasonable use of and access to our services and website or to the contents and components of those services or website or are in any way in breach of these terms and conditions.
5. Payments & Refunds.
5.1. If you wish to purchase any product or service made available through the service or website (“Purchase”), you may be asked to supply certain information relevant to your Purchase.
This includes without limitation:
Your credit card or debit card number, the expiration date of your credit card or debit card, your full legal name and your billing address.
5.2. You represent and warrant that:
You have the legal right to use any credit or debit card(s) or other payment method(s) in connection with any Purchase.
The information you supply to us is true, correct, and complete.
5.3. We reserve the right to refuse or cancel your order at any time for reasons including but not limited to product availability, errors in the description or price of the product or service, and errors in your order.
5.4. Once purchased, any training sessions/classes, services or other purchases are non-refundable and non-transferable except in specific cases (see “Refunds” below).
5.5. All payments for our ‘in person’ group and personal training services should be made a minimum of five business days in advance. Upon payment confirmation, your service will move from being provisional to being confirmed.
5.6. Once payment is made, you will receive confirmation of payment received and the date, time, location and duration of your service(s).
5.7. Teen Training.
Our Teen Training sessions work on a subscription service consisting of regular weekly payments.
If a client prefers to pay four-weekly (every 28 days), this can also be arranged.
Participation in our regular training services does not constitute a contract and your service can be cancelled at any time. Simply let us know. You/your teen will still be confirmed to take part in any session already paid for, then you should cancel your regular payment via your own banking institution. We are not responsible for cancelling standing orders or other regular payment methods.
We believe that teenagers will receive the full benefit of our teen training service by participating in regular sessions which gives stability and structure to your teens’ physical growth while also imparting the need of self-discipline to undertake regular physical exercise.
Queensland state law limits the number of teenaged clients attending each session be no more than 10 for safety and security reasons so spaces are extremely limited.
Making payment in advance helps us keep your teenager’s spot in the training service. Late or missed payments may result in your teenager’s spot being offered to someone else.
5.8. GST and Price Changes.
You understand that while BTC Fitness does not currently charge GST on our prices, we may be required by law to add GST to the cost of sessions at any point. You also understand that prices may increase in line with inflation and rising costs of living. You will be notified in at least 30 days in advance of any price increases or changes to costs. You are within your rights to cancel at any point.
5.9. Payment methods.
We are a small family business and, as such, do not recommend payment via debit or credit card. While we can take payment this way, doing so would incur extra bank and card payment clearing charges which may be passed on to you, the client.
Our preferred choice of payment method is bank transfers for single payments and/or standing orders for recurring payments.

5.10. Refunds
Except when required by law, BTC Fitness shall be under no obligation to refund any payment made for services or products. However, we may offer refunds on a case-by-case basis. Please refer to our Refund Policy at: https://btcfitness.com.au/btc-fitness-refund-policy/ for detailed information.
6. Cancellations, Rescheduling and Late Arrivals.
6.1. 48 hours’ notice of cancellation or postponement is required for all appointments and pre-booked sessions. Notice of less than 48 hours may incur full payment of the full session/class fee. No refunds will be given for pre-paid sessions/classes cancelled or postponed with less than 48 hours’ notice except at our discretion.
6.2. Once purchased, your sessions/classes are non-refundable and non-transferable.
6.3. If a client arrives late to a session/class, that session/class cannot be extended and will end at the appointed time. Clients are welcome to participate in the remainder of the session/class, but no arrangements will be made for that client to ‘catch up’ with the time missed. i.e. If a client pre-books and pays in advance for a 1-hour session and arrives at the session 25 minutes late, that client will only be able to participate in the remaining 35 minutes of the pre-booked 1-hour session. The fact that the client has paid for 1 hour of training/session is irrelevant in these cases. We encourage all clients to attend sessions/classes promptly.
6.4. In the unlikely event that a trainer, through unforeseen circumstances, is late to, or absent from, a session, a full refund for that session will be credited to the client’s account and subtracted from the client’s next payment. In the event that a client has no further sessions booked, a refund will be given.
7. Teen Training Special Terms and Conditions.
The following terms and conditions relate solely to our ‘Teen Training’ program.
When signing your child up to participate in BTC Fitness activities, you and your child agree to the following:
7.1. You agree that there is always a certain amount of risk involved in all exercise and as such BTC fitness cannot be held reasonable for any injuries sustained during participation of any activity.
7.2. Getting your child to school on time – BTC Fitness is NOT a childminding service. It is the responsibility of the child and parent/guardian to ensure children get to class/school on time. Morning sessions will end with enough time for children to get to school. (Approximately 30 minutes depending on when your child starts school.)
7.3. Ensuring your child attends sessions. Payment will still be taken if children decide not to attend, even if parents/guardians are not aware of the child’s non-attendance. BTC Fitness holds no responsibility for your child’s whereabouts should they decide not to attend.
7.4. Your child’s belongings: Jewellery is not advised during sessions and must be removed before sessions commence. Should children wear any jewellery it is their responsibility to keep the item(s) safe. Any personal property your child brings to the session is their responsibility. It is advised that children’s belongings are labelled to save any confusion or loss of property and children only bring what is necessary. (i.e., Water bottles, towels, sports clothing, school belongings)
7.5. You understand that it is in your child’s best interest to only participate in one session per day. Too much training can be detrimental to health and as such, we will only train a child once each day irrespective of how many sessions/classes are offered by us each day.
7.6. Parent/guardian responsibilities:
- 7.6.1 Parents/guardians acknowledge that BTC Fitness is not a child-minding service. Outside of the confines of the training sessions we are not responsible for your child in any way. Our service is provided to children with a minimum age of 13 and it is presumed that children of 13 and above can be responsible for their own actions, care and supervision. This corresponds with Queensland law regarding working with children.
- 7.6.2. The morning sessions begin at approximately 7:00 am and finish at 8:00 am. Afternoon sessions begin at 3:00pm and finish at 4:00pm. It is your (the parent/guardian’s) responsibility to ensure children arrive at sessions on time. Should children have a certain time they need to arrive home, it is their responsibility to follow their own rules set out by parents/guardians. BTC Fitness are not responsible for children’s time management. Once the session ends, all responsibility is placed on the children and/or parent/guardian to ensure children arrive home and/or at school at the appropriate times. If children continuously arrive at school/sessions late, BTC Fitness has the right to remove them from the program and any fees due will need to be paid in full.
- 7.6.3. If, for any reason, your child cannot attend a session/class, it is the parents/guardian’s responsibility to let the trainer know (via text, email or phone call) at least 48 hours before the session in question is due to start or payment will still be taken. Children are not able to cancel any sessions/classes, and this is the sole responsibility of the parent/guardian.
- 7.6.4. Ensuring your child is wearing appropriate clothing – i.e., no singlets or open toed shoes of any kind.
- 7.6.5. Ensuring your child is sun safe. We recommend applying sunscreen 20 minutes before the sessions commence and for all participants to wear sun safe clothing.
- 7.6.6. You (the parent/guardian) agree not to allow your children to bring any family and/or friends to the sessions unless they are already signed up to the program via their own parent/guardian’s consent. If your child wishes to bring a friend and/or family member, you must first speak with the trainer to ensure we have space available while also obtaining permission and consent from their parent/guardian. Each child must also complete their own pre-screening health questionnaire. Friends/family are welcome to stay for the purpose of encouragement and moral/emotional support.
- 7.6.7. In cases of emergency, parents/guardians authorize us to contact medical services and provide necessary treatment, with any associated costs borne by the parent/guardian.
- 7.6.8. BTC Fitness is an all-inclusive program, you (the parent/guardian) agree that for your child to participate in sessions, they understand that bullying, intimidation and ridiculing of any person will not be tolerated. Instead, children should show a spirit of trust and goodwill among people and cheer on the team no matter their age, gender, beliefs or fitness level. By agreeing to these terms and conditions you understand that any type of bullying or abhorrent behaviour may result in removal from the program and any payments due to BTC Fitness will need to be made in full.
- 7.6.9. If your child does not attend a scheduled training session/class and no contact has been made by the parent/guardian to explain the absence, BTC Fitness will attempt to contact the emergency contact named on our Teen Training Agreement Membership document to inform of that absence. Ideally this contact will be made within 30 minutes of the start time of the scheduled session/class however we cannot guarantee this will be the case.
- 7.6.10. If there is any situation regarding a child during the scheduled session/class, such as an injury or other emergency. BTC Fitness will attempt to contact the emergency contact named on our Teen Training Agreement Membership document as soon as possible to inform parents/guardians of that situation.
7.7 Children’s responsibilities:
- 7.7.1. For the safety of everyone, you (the child) agree not to bring any family and/or friends to the sessions without first speaking with a parent and the trainer taking the classes.
- 7.7.2. You (the child) agree that to take part in BTC Fitness programs, you will not bully, intimidate and ridicule any persons. Instead, you will show a spirit of trust and goodwill among people and cheer on the team no matter their age, gender, beliefs or fitness level. At BTC Fitness we are all friends, and any type of bullying may result in your removal from the program.
- 7.7.3. You (the child) understand that it is your responsibility to get to school/class/home on time. If you are continuously late to class/sessions/school, BTC Fitness has the right to remove you from the program. By agreeing to these terms and conditions you agree to attend school at the appropriate times.
- 7.7.4. You (the child) understand that if your parents have given you a set time to be home after the sessions end, it is your responsibility to follow these rules accordingly and that it is not the fault of BTC Fitness if you are late home or to school.
- 7.7.5. You (the child) agree to apply sunscreen 20 minutes before attending a session and to wear sun safe clothing. BTC Fitness can provide sunscreen, but you understand if you apply sunscreen at the start of the session, you will have to miss 20 minutes of the session and wait in a shaded area. You also agree to wear appropriate clothing for fitness (i.e., No open-toed shoes and/or singlets).
8. Code of Conduct
8.1. All participants are expected to:
- Follow instructions provided by trainers.
- Respect other participants and trainers.
- Refrain from disruptive or unsafe behaviour.
8.2. We reserve the right to suspend or terminate participation if these standards are not met.
9. Termination
We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms.
Upon termination, your right to use the services will cease immediately.
10. Limitation of Liability
10.1. While we take reasonable precautions to ensure the safety of participants, we are not liable for:
- Injuries, accidents, or loss of personal property arising from participation.
- Third-party actions or omissions during school-based or external events.
10.2. Our liability is limited to the fullest extent permissible by Australian law.
11. Privacy and Data Protection
11.1. We collect personal information for registration and service delivery purposes. This includes:
- Participant’s name, age, and medical history.
- Parent/guardian contact details.
11.2. All data is handled in compliance with the Privacy Act 1988 (Qld) and the Australian Privacy Principles.
11.3. We will not share personal information with third parties without your consent, except as required by law in Queensland.
12. Use of Media
12.1. We may take photos or videos during sessions for marketing and promotional purposes. These will only be used with your consent.
12.2. If you do not wish your child to be photographed or recorded, please notify us in writing.
13. Dispute Resolution
13.1. Any disputes arising from our services will be resolved in accordance with the laws of Queensland, Australia.
13.2. Parties agree to attempt mediation before pursuing legal action.
14. Governing Law
These Terms shall be governed and construed in accordance with the laws of
Queensland/Australia, without regard to its conflict of law provisions.
15. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least [30] days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

*‘in person’ training means any and all physical training instructions, programs and sessions delivered in person, face to face, by one of our staff members. It does not apply to digital products sold via our website or general information contained on our website.
17. 20K K2K Cycling Challenge Terms & Conditions.
17.1. General Information
The 20K K2K Cycling challenge is a cycling activity designed for young riders aged 13 to 17. The event takes place every Saturday at 10 AM, commencing from Blatchford Sporting and Recreation Reserve. Riders walk with their bikes to the Kallangur cycling track’s starting point before embarking on a journey to Kippa-Ring Station and returning to Blatchford Sporting and Recreation Reserve.
A signed consent form from a parent or legal guardian is required for participation and this constitutes acceptance of these terms.
Participants must be in good health and possess the physical ability to complete the challenge.
17.2. Nature of the Initiative
This 20K K2K Challenge is not a race but an opportunity to experience the journey, build teamwork, and improve cycling endurance and general fitness. The goal is to progressively reduce group completion times while ensuring an enjoyable experience for all participants.
We all ride as a single group at the pace of the slowest rider. Our aim is to reduce completion time for the whole group by helping and encouraging each other to ride faster.
17.3. Supervision and Safety
The group is led by two designated supervisors: one leads the group while another is positioned at the rear to keep the group together.
All riders must stay together, and no participant will be left behind.
Safety is a priority, and riders are expected to always follow instructions.
17.4. Equipment and Rider Requirements
- Participants must provide their own bicycles and safety certified helmets in good condition.
- Riders must possess competent cycling skills to ensure their safety and the safety of the group.
- Riders must stay on the designated course and obey all traffic and event-related signals.
- Parents/guardians must ensure that their child’s bicycle is in good working condition before each session. A handy checklist of what to look out for can be found here.
- Participant’s bicycles must be mechanically sound with no structural damage. Moving parts should be properly lubricated and running smoothly – wheels, cranks, gearing systems etc.
- All bicycles should have fully functioning front and rear braking systems with plenty of use left in brake blocks/disks/pads.
- Wheels should be straight and true with no major buckles, broken or missing spokes or rim damage. We accept that small buckles happen, especially with children’s bikes and slight bends or buckles will be acceptable if they do not cause a danger to the rider, limit braking function or have potential for complete failure of the wheel.
- Tyres should have an acceptable amount of tread on them. No bald spots or structural failures should be present such as bulges, damaged side walls, incorrectly seated beads or other damage.
- All adjustable components should be correctly fastened, tightened and secure – seat stems, handlebar risers etc.
- As all sessions will begin with a short warm up session, Bradley will conduct a brief safety check on all bicycles during this time. This brief safety check does not make us liable should any failure or malfunction occur during the challenge and does not serve as a replacement or substitute for a more thorough and consistent maintenance schedule which should be performed by parents/guardians. If a participant’s bicycle passes this brief safety check, we still accept no responsibility for a bicycle failing or breaking down at any point. Any major defects or malfunctions found during the safety check will result in that rider being unable to participate.
- We cannot be held responsible for a participant being refused participation and left behind due to a mechanically unsafe bicycle.
- Any mechanical issues that cause delays may result in additional fees for repairs or assistance.
- To comply with Australian and the State of Queensland law regarding cycling ALL bicycles must have a bell, horn or other warning device. It is recommended that each bicycle should also have installed: a white coloured front reflector and a red coloured rear reflector. 17.5. Meeting and Departure Protocol
Participants may head home independently after the ride or wait for parental pickup at Blatchford Sporting and Recreation Reserve.
Parents/guardians are responsible for ensuring timely pickup if required.
17.6. Code of Conduct
Riders must respect their peers, supervisors, and the public.
Unsafe riding, reckless behaviour, or refusal to follow instructions may result in exclusion from future sessions.
Helmets must be worn at all times while riding.
17.7. Liability and Waiver
Parents/guardians must sign a consent form before their child can participate.
Participants and their legal guardians acknowledge and accept that bicycling carries inherent risks, including but not limited to falls, collisions, and mechanical failures.
BTC Fitness, the organizers, sponsors, supervisors, and any associated entities shall not be held liable for any injuries, damages, or losses sustained during the Event.
Participants and their legal guardians agree to release, indemnify, and hold harmless BTC Fitness, the organizers and supervisors from any claims, liabilities, costs, or expenses that arise from participation in the Event.
In case of mechanical failure, BTC Fitness will not be responsible for repairs or replacements of any equipment.
It is the responsibility of participants and their legal guardians to ensure the bicycle is properly maintained before the Event.
17.8. Emergency Procedures
In the event of an accident, medical assistance will be provided on-site.
Organizers reserve the right to withdraw any participant from the Event if they deem it necessary for safety reasons.
Participants must provide emergency contact information before the Event.
17.9. Weather Conditions and Cancellations
Sessions may be postponed or cancelled due to extreme weather conditions or unforeseen circumstances.
In the event of weather conditions changing during the session, we will endeavour to continue as long as the weather conditions are not hazardous.
Parents/guardians agree that there may be occasions where their child is caught in sudden rain and may, as a result, get wet with no way of getting dry or changing clothes until they return home. While we will take all reasonable steps to avoid this circumstance, obviously it is something out of our control.
Parents/guardians will be notified of cancellations via the provided contact details.
